On January 5, 2012, upon invitation of JETRO, UIP Attorney Liu Jing delivered keynote speech on Civil Litigation Strategies and Technics in IPR Protection in the Guangdong IPG Meeting & IPR Protection Seminar at Grand Mercure Oriental Ginza, Shenzhen. About 50 enterprises and 100 right holder representatives attended the seminar.
 
In his speech, Attorney Liu Jing gave introduction on the dual-track system and current situation of IPR protection in China, and analyzed the features of administrative protection and judicial protection of IPR with the introduction of “Iceberg Model”, “Contour Curve Model” and “Profit-Risk Matrix”. By contrast between the cost of right holders and the cost of infringers in the two IPR protection approaches, Attorney Liu Jing introduced the importance of judicial protection of IPR by vividly explaining judicial protection of IPR to be multiplier of IPR protection effect, and redactor of cost of IPR protection.
 
Through cases of YAMAHA, PUMA and EPSON’s IPR protection, Attorney Liu Jing introduced to the seminar on the following issues: (1) How to combine “legal ability” and “investigation ability” seamlessly?; (2) How to integrate “administrative protection” with “judicial protection”?; (3) How to achieve the target of “litigation” by means of “non-litigation”?; (3) How to work out different strategies for IPR protection in different links of Industrial Chain in different industries to conduct continuous effective attack on key infringers at key links of industrial chain? At the end of his speech, Attorney Liu Jing also shared various practical tips for IPR civil litigation and discussed IPR protection strategies with right holders.
 
Attendants at the seminar spoke highly of the speech. Right holder Representatives expressed that confronting more and more infringers, how to make the best of administrative protection and judicial protection of IPR was the biggest challenge pending solution, and Attorney Liu Jing’s experience of IPR protection made great inspiration to right holders and provided new vision for IPR protection.
